Product: Old Soren Cafe Racer
IMPORTANT NOTICE
By purchasing, taking possession of, assembling, charging, riding, or using the Old Soren Cafe Racer ("the Product"), you acknowledge that you have read and agreed to this Safety Notice and Release of Liability. If you do not agree, do not use the Product and contact Old Soren Motorcycle Co., LLC before use.
1. Assumption of Risk
Riding an electric motorcycle involves inherent risks, including loss of control, collisions, mechanical or electrical failure, battery malfunction, road hazards, rider error, and environmental conditions. These risks may result in serious injury, death, or property damage. By using the Product, you voluntarily assume all risks associated with its use, whether foreseeable or unforeseeable.
2. Release of Liability
To the fullest extent permitted by law, you agree to release and hold harmless Old Soren Motorcycle Co., LLC and its owners, employees, contractors, suppliers, and affiliates from any claims, damages, injuries, or losses arising from the purchase, possession, assembly, charging, storage, transport, or use of the Product, including claims based on ordinary negligence. This does not apply to gross negligence or willful misconduct where prohibited by law.
3. Battery Safety Notice
The Product uses a lithium-ion battery, which can pose a risk of fire, explosion, injury, or property damage if misused. You agree to:
- Use only the provided or approved charger
- Charge in a dry, well-ventilated area on a non-flammable surface
- Never charge unattended or overnight
- Stop use if the battery shows damage, swelling, overheating, or abnormal odor
- Never open, modify, drop, puncture, or tamper with the battery
Old Soren Motorcycle Co., LLC is not responsible for damage or injury resulting from improper battery use or charging.
4. Bolt Inspection & Maintenance Requirement
Normal riding vibration can cause bolts and fasteners to loosen over time. Before every ride, you agree to:
- Inspect and tighten all critical bolts and fasteners (wheels, handlebars, brakes, seat, battery mounts)
- Check tire pressure and brake function
You are solely responsible for routine maintenance and safe operation. Old Soren Motorcycle Co., LLC is not responsible for injuries or damages resulting from lack of maintenance or improper repairs.
5. Legal Compliance
You agree to follow all applicable local, state, and federal laws regarding e-motorcycle operation, helmet use, and safety requirements. Legal compliance is solely your responsibility.
6. Binding Agreement Through Use
By purchasing or using the Product, you agree that: you accept all risks associated with the Product; you release Old Soren Motorcycle Co., LLC from liability as stated above; and this agreement is legally binding without a physical signature.
Sections 7–10 below are draft additions pending attorney review — not yet finalized.
7. Eligibility
This Product is intended for adult riders. By using the Product, you represent that you are at least 18 years of age (or the age of legal majority in your jurisdiction) and hold any license or permit required by law to operate the Product on public roads.
8. Governing Law & Venue
This Notice is governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute arising from or related to this Notice or the Product shall be brought exclusively in the state or federal courts located in Los Angeles County, California.
9. Severability
If any provision of this Notice is found by a court of competent jurisdiction to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
10. No Waiver of Non-Waivable Rights
Nothing in this Notice is intended to limit or waive any right or remedy that cannot be limited or waived under applicable law, including certain product liability and consumer protection laws.
